Who may use Nook
Nook is designed for parents, guardians and other adult carers aged 18 or over. It is not a child-directed service and a child must not create or control a Nook family space. You must have legal authority to add information about a child and to invite another person to access it.
Before adding sensitive or health-related information about a child, you must have the parent's, guardian's or other legally authorised person's permission where required. You must not invite a carer unless you are authorised to share the family information they will be able to see.
You are responsible for keeping your device, Apple ID and family invitations secure and for the activity of people you authorise. The family owner controls invitations, removals and permanent family deletion.
What Nook does—and does not do
Nook helps adults record everyday care, share handovers, keep private family moments and view clearly labelled estimates or general age-aware guidance. Records depend on what carers enter and may be late, incomplete or wrong. Estimates and suggested ranges are not recorded facts and are not promises about a child.
You must independently check information before relying on it for a decision affecting health, feeding, sleep safety, medication, supervision or wellbeing. Always seek advice from a qualified healthcare professional about a child's health or development. Nook is not a baby monitor, clinical record, medication system, alarm service or substitute for watching a child.
Your family content
You retain ownership of the names, care records, notes, photos, videos and other material you add. You give Nook a limited permission to process that content only to operate, secure, sync, display, export and support the service as described in the Privacy Policy.
You must not add content unlawfully, infringe another person's privacy, confidentiality or intellectual-property rights, or share information you are not authorised to share. You are responsible for obtaining any permission needed from other adults shown or identified in content and for considering the child's privacy, dignity and best interests.
Nook does not claim ownership of family content. A carer you authorise may see, export or save information while they have access. Removing them stops future cloud access but cannot erase a copy they lawfully made before removal.
Acceptable use
You must not misuse Nook, attempt unauthorised access, interfere with security or availability, reverse engineer the service except where law expressly permits it, upload malicious material, impersonate another person, or use Nook to harass, exploit or endanger anyone. You must not use Nook for unlawful surveillance or to make automated or high-stakes decisions about a child.
We may restrict access when reasonably necessary to protect users, comply with law, investigate serious misuse or maintain service security. Where practical, we will give notice and a reasonable opportunity to export information first.
Subscriptions and Apple billing
When paid access becomes available, subscriptions will be purchased and managed through Apple's App Store. Before you confirm a purchase, Apple and Nook will show the subscription name, what is included, the billing period, the full renewal price and the length and post-trial price of any introductory trial. The App Store price shown at confirmation controls if it differs from an earlier marketing price.
Unless cancelled through your Apple account settings at least 24 hours before the end of the current period, an auto-renewable subscription renews under Apple's billing terms. Eligibility for a free trial is determined by Apple. Cancelling stops future renewal but does not by itself refund the current period. Deleting Nook does not cancel a subscription. Apple processes payments and handles App Store refund requests.
You can manage or cancel through Apple's subscription settings and restore eligible purchases in Nook. Price changes will be handled through Apple's notice and consent process where required. Nothing in these terms limits rights you have under the Australian Consumer Law or another law that cannot be excluded.
Where Apple Family Sharing is enabled, a subscriber may share Nook with up to five other members of their Apple Family Sharing group only when Apple supplies a verified shared StoreKit entitlement for that person. A Nook CloudKit invitation controls access to a private family care space; it does not prove purchase and does not transfer a subscription. An invited carer outside the subscriber's Apple family must have their own verified Nook subscription.
Availability and changes
Nook may change as features are improved or legal and platform requirements evolve. We do not promise uninterrupted, error-free or permanent availability. iCloud, CloudKit, App Store, device permissions, internet access and operating-system behaviour are controlled by third parties and may affect Nook.
We will not intentionally remove a paid core feature during a prepaid period without an appropriate remedy where required by law. Keep your own export if you need an independent copy of family information.
Nook's intellectual property
Nook's app, website, branding, illustrations, interface, text and software are owned by or licensed to Nook. Subject to these terms, you receive a personal, limited, non-exclusive, non-transferable and revocable licence to use the app for private family care. No other rights are granted.
Privacy and third-party services
Our Privacy Policy explains how information is handled. Nook relies on Apple services, including iCloud, CloudKit, StoreKit, notifications and device security. Your use of those services is also subject to Apple's terms and privacy policy. Links to outside information are provided for convenience and do not make Nook responsible for that content.
Third-party services may be unavailable, delayed or changed independently of Nook. We are responsible for our own conduct and obligations, but not for a third party's separate service to the extent permitted by law.
Consumer rights, disclaimers and liability
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
Subject to those rights, Nook is provided on an “as available” basis. To the maximum extent permitted by law, Nook does not guarantee that a care record, estimate, notification, sync, handover or third-party service will always be accurate, complete, timely or available. You remain responsible for checking information and obtaining appropriate professional advice before making a decision affecting a child's health, feeding, sleep safety, medication, supervision or wellbeing.
To the maximum extent permitted by law, Nook is not liable for loss to the extent it is caused by information entered incorrectly, access you authorised, failure to secure a device or Apple ID, or events outside Nook's reasonable control. Nook is not liable for indirect or consequential loss that was not reasonably foreseeable when you began using the service. These limits do not apply to fraud, wilful misconduct, personal injury caused by negligence, breach of an applicable consumer guarantee, or any liability that law does not allow us to limit.
Ending use and deleting data
You may stop using Nook at any time. Removing the app does not necessarily cancel an Apple subscription or delete the family's CloudKit records. Cancel subscriptions through Apple and use Nook's privacy and family-access tools to export, leave or permanently delete data.
Provisions that by their nature should continue—including ownership, consumer rights, disclaimers and liability—survive the end of these terms.
Governing law and changes
These terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws. Courts with jurisdiction in Victoria may hear disputes, subject to any right you have to bring a claim elsewhere under mandatory consumer law.
Before starting formal proceedings, you and Nook should try in good faith to resolve a complaint through the Contact page, unless urgent relief is needed. This does not limit a right to contact a regulator, exercise a consumer remedy or bring a claim.
We may update these terms for legal, security or product reasons. Material changes will apply prospectively, will be notified appropriately and will not remove accrued consumer rights. Where consent is legally required, continued use alone will not replace that consent.
Apple terms
If you download Nook from Apple's App Store, Apple's Standard End User Licence Agreement applies except to the extent these terms validly supplement it. Apple is not responsible for Nook's content, support or claims, except for any obligations Apple expressly accepts. Nothing here overrides Apple's terms or your mandatory legal rights.
